La signification de l’article 23 de la Charte et son étendue aujourd’hui dans les communautés minoritaires francophones : vers une transculturalité réelle

La présente réflexion portera sur les quatre éléments suivants : dans un premier temps, je compte signaler la place de la décision Mahe1 dans les 25 ans d’histoire de la Charte2; deux- ièmement, il sera question du sens de Mahe à partir d’une interprétation qui situe le jugement dans son contexte historique et politique; en troisième lieu, l’application aujourd’hui relative à son étendue et par rapport à la nouvelle don- ne démographique; et pour finir, les modalités d’intervention par les communautés dans ce nouveau contexte.
